Chris has a great deal of experience with insolvency actions, regularly working with liquidators and creditors in matters involving tracing claims and contested voidable transactions.
Insolvency proceedings often arise when a company or individual is unable to pay their debts. In New Zealand, corporate and personal insolvency is regulated by the Companies Act, Receivership Act and the Insolvency Act. The High Court has exclusive jurisdiction to determine creditor applications, to appoint and replace liquidators, to seek orders adjudicating a debtor bankrupt, and to approve creditor compromise proposals. The High Court’s exclusive jurisdiction extends to resolving disputes involving non-legally binding and unlawful transactions (pursuant to the Property Law Act).
