Chris has acted for both plaintiffs and defendants in negligence claims against various professionals. These include valuers, accountants, architects, surveyors and lawyers.
He has also been counsel in several “leaky building” cases, appearing before the Weathertight Homes Tribunal and in the High Court with regards to several large multi-unit development claims.
Professional negligence cases involve professionals failing to use reasonable care, resulting in damage or injury. At the heart of these matters is the scope of the duty of care that a professional owes to any parties who claim that they have suffered a loss as a result of some action or omission by that professional. The establishment of a duty of care is one part of the assessment conducted by the Court. Often the more complex assessment is the issue of loss. Many cases are decided in respect to issues relating to the cause and amount of loss(es) actually suffered.
