Bankrupt but living in a 4 million dollar home owned by the family trust but financed by creditors? Does not quite seem that fair and equitable.
It has been reported that there are over 400 discretionary trusts being used in New Zealand today. The use of trusts as a form of creditor protection has resulted in creditors being denied the ability to recover money that would otherwise have been received by them. Trusts are a creation of equity. The law has never allowed debtors to place their assets beyond the reach of their creditors through the use of a discretionary trust. Unfortunately, the vulnerability of debtor’s discretionary trusts is often poorly or completely misunderstood or not even considered by creditors. This webinar will look at the various steps that can be taken to make the assets held by a discretionary trust available to creditors.
The Webinar will be of value to commercial solicitors and their clients who are value and wish to protect their confidential and proprietary information against unauthorised use or disclosure by their employees.
The Webinar will be presented by Chris Patterson, Barrister. Chris has been counsel in a scores of procceedings involving theunauthorised use and/or disclosure of confidential information.
